This Prenuptial Agreement, referred to herein as the "Agreement," is entered into on this ______ day of _______________, 20____, by and between _______________________, hereafter referred to as "Party One," and _______________________, hereafter referred to as "Party Two."
WHEREAS, Party One and Party Two are planning to marry under the laws of the State of Rhode Island, and
WHEREAS, both parties wish to establish their respective rights and responsibilities concerning their individual and joint property both during their marriage and in the event that their marriage should come to an end, whether by divorce, annulment, or death;
NOW, THEREFORE, in consideration of the marriage and mutual covenants and agreements hereinafter contained, Party One and Party Two agree as follows:
- Disclosure of Assets and Liabilities: Each party has fully disclosed to the other party their respective financial assets and liabilities, as further detailed in Exhibits A and B attached hereto.
- Governing Law: This Agreement shall be governed by and construed in accordance with the laws of the State of Rhode Island, without giving effect to any choice-of-law or conflict-of-law provisions.
- Amendments: Any amendments to this Agreement must be made in writing and signed by both parties to be legally binding.
- Separate Property: Each party's separate property, as detailed in Exhibit A (for Party One) and Exhibit B (for Party Two), shall remain the sole property of that party throughout the duration of the marriage.
- Marital Property: All property acquired by either party during the marriage shall be considered marital property and divided in accordance with Rhode Island law in the event of a divorce, annulment, or other dissolution of the marriage.
- Spousal Support: The rights to seek spousal support, including but not limited to alimony, shall be governed by this Agreement and may be waived or modified herein.
- Sunset Clause: (Optional) This Agreement shall become void upon the ______ anniversary of the marriage, unless the parties agree to renew the Agreement in writing.
